According to the NSW Government's published transition arrangements, only e-bikes that complywith European Standard EN 15194 will be permitted on NSW roads and road-related areas from 1March 2029.E-bikes with a maximum continuous rated power between 251W and 500W will no longer be road legal.E-bikes rated at 250W or less that do not meet EN 15194 will also become non-compliant.There is currently no general exemption for bikes purchased before the change.
A non-compliant e-bike may still be used on private property with the property owner's permission.

Can a software update make my existing e-bike compliant for 2029?

Accepted Answer

A software restriction by itself will not be sufficient. The NSW Government specifically states thatan e-bike capable of operating above 250W will not become legal merely because software limits itto 250W.EN 15194 applies to the complete e-bike, including its motor output, controller, speed assistance,electrical system, braking and other safety requirements. Compliance must apply to the exactmodel and be supported by manufacturer certification.A manufacturer could potentially develop and certify an approved conversion in the future, but nosuch program should be assumed unless the manufacturer provides written EN 15194 certificationfor the converted model.

Is every 250W e-bike automatically legal after 2029?

No. A 250W label or software setting does not by itself demonstrate compliance. NSW Fair Tradingexplains that retailers must display either a green EN 15194 compliant tag or a red non-compliancetag for each e-bike model. The green tag should be supported by manufacturer documentationapplying to the exact bike model.Customers should not rely solely on terms such as '250W mode', 'road mode' or 'software limited.'

A throttle or walk-assist control is permitted only when it stops providing power at 6km/h. Above6km/h, a road-legal e-bike must be primarily propelled by the rider pedalling, and all motorassistance must stop at 25km/h.The NSW Government's e-bike guidance states that an e-bike capable of throttle-only riding above6km/h is not legal on NSW roads or public paths and may only be used on private property.Simply promising not to use the throttle, isolating it for a trip or selecting a restricted mode doesnot necessarily establish compliance if the bike remains capable of throttle-only propulsion above6km/h. Before purchasing, ask the retailer to confirm in writing that the throttle is permanentlylimited to 6km/h and that the exact model's operation and certification satisfy the NSWrequirements.

All riders and passengers must wear an approved, properly fitted andfastened helmet.
